Rojales sits on both banks of the Segura river, 12 km inland from Torrevieja, and combines a historic Spanish town centre with large international urbanisations such as Benimar, Doña Pepa, La Marquesa and Lo Pepín. Roughly half of its registered population is foreign — British, Dutch, Belgian, Norwegian, Swedish and German. Rojales generates very particular legal work: rural and semi-rural plots, extensions built without a licence that need an AFO or catastral correction, community of owners disputes in the big urbanisations, and cross-border inheritance. Buying in Rojales: Rural Plots, AFO and the Checks Nobody Tells You About

Rojales is one of the municipalities on the Vega Baja where the difference between urban land, urbanisable land and rustic land matters most. A large share of the villas sold in Lo Pepín, Los Palacios and the outskirts of Benimar sit on plots that were classified as rustic when the house was built, or have pools, porches and annexes added later without a municipal licence.

Before signing anything we check:

  • Nota Simple and whether the built surface at the Land Registry matches the Catastro and reality.
  • Urban planning certificate (cédula urbanística) from Rojales town hall: classification, buildable ratio and setbacks.
  • Whether the works are out of the infringement time limit and can be regularised through an AFO (Declaración de Situación Individualizada de Fuera de Ordenación) or need a catastral correction under art. 18.2 TRLCI.
  • Segura river flood zone (PATRICOVA) affections, which are real in the lower parts of the municipality.
  • Community of owners debt certificate in the urbanisations.

Buying a house with an unlicensed extension is not necessarily a mistake — but the price and the legalisation cost must be negotiated before the escritura, not after.

Inheritance in Rojales: British, Dutch and Norwegian Owners

A very large part of the housing stock in Benimar, Doña Pepa and La Marquesa was bought in the 1990s and 2000s by foreign couples who are now in their seventies and eighties. When one of them dies, the heirs face a Spanish probate they did not plan for.

The practical route is always the same:

  1. Death certificate, apostilled and translated if issued abroad.
  2. Certificate from the Spanish Registry of Last Wills (*Registro de Actos de Última Voluntad*).
  3. Spanish will if there is one; otherwise the foreign will plus a certificate of law, or the EU Succession Regulation 650/2012 rules.
  4. NIE for every heir.
  5. Notarial deed of acceptance and adjudication of the inheritance.
  6. Inheritance tax (ISD) within 6 months — in the Comunidad Valenciana the 99% relief for spouse, children and parents applies from 2024, which usually reduces the bill to almost nothing.
  7. Plusvalía Municipal at Rojales town hall and registration at the Land Registry of Rojales.

Heirs living abroad do not need to travel: a power of attorney signed at the Spanish consulate or before a local notary with apostille is enough for us to complete the whole process.

Communities of Owners in Benimar, Doña Pepa and La Marquesa

The large Rojales urbanisations are governed by the Ley de Propiedad Horizontal (LPH) and, in some cases, by *entidades urbanísticas de conservación*, which is a different legal animal and a frequent source of confusion for foreign owners.

The disputes we see most often:

  • Special levies (derramas) for pool, road or water network refurbishment, and whether the owner who bought afterwards has to pay them.
  • Owners who do not pay: monitorio claim under article 21 LPH.
  • Challenging a community resolution — strict 3-month limit under article 18 LPH (1 year if the resolution is contrary to law or to the by-laws).
  • Restrictions on holiday rentals, which now require the regional licence plus the national NRA number.
  • Liability of the administrator or president for negligent management.
