Conveyancing Solicitors in Torrevieja & Costa Blanca
Spain's property market continues to attract buyers from across Europe and beyond, especially along the Costa Blanca. At Bufete Padilla, our conveyancing solicitors in Torrevieja and Moraira have been handling property transactions since 1976. We conduct thorough legal due diligence, verify land registry records, check for outstanding debts and charges, negotiate contracts, attend the notary signing, and ensure all taxes and fees are paid correctly — including ITP (transfer tax), plusvalía municipal, and notary and registry fees.
What Does a Conveyancing Solicitor Do in Spain?
Unlike in the UK, in Spain there is no legal obligation to use a solicitor when buying property — but it is strongly recommended. Estate agents and notaries do not protect your interests as a buyer. A conveyancing solicitor:
Checks the land registry (Registro de la Propiedad) to confirm ownership and identify any charges, mortgages or embargos
Verifies planning permissions and checks for illegal constructions or building infractions
Reviews the cadastral reference (catastro) to ensure the declared area matches reality
Negotiates and drafts contracts — arras (deposit contract) and private purchase agreements
Coordinates with the bank for mortgage arrangements
Attends the notary signing (escritura) and ensures funds are transferred correctly
Pays all taxes: ITP (transfer tax at 10% in the Valencian Community), plusvalía municipal, AJD if applicable, and registers the property in your name
Sets up direct debits for IBI (council tax), basura (waste tax), and community fees
Without a solicitor, you risk buying a property with hidden debts, illegal extensions, or incorrect boundaries.
Costs & Taxes When Buying Property in Spain
As a rule of thumb, budget approximately 12–14% on top of the purchase price for taxes and fees when buying a resale property in the Valencian Community:
ITP (Impuesto de Transmisiones Patrimoniales): 10% of the purchase price for resale properties
AJD (Actos Jurídicos Documentados): 1.5% for new-build properties (instead of ITP, plus 10% IVA/VAT)
Notary fees: Typically €600–€1,200 depending on the price
Land Registry fees: Typically €400–€800
Legal fees: Our fees are transparent and competitive — contact us for a quote
Plusvalía municipal: The seller's obligation (but negotiable in practice)
Mortgage costs: If financing, add valuation fees, bank arrangement fees, and AJD on the mortgage deed
We provide a detailed cost breakdown before you sign any contract, so there are no surprises.
Frequently Asked Questions
Do I need a lawyer to buy property in Spain?
While not legally required, it is strongly recommended. A conveyancing solicitor protects your interests, verifies the property is debt-free, and ensures all taxes are paid correctly.
Can I buy property in Spain remotely with a Power of Attorney?
Yes. We regularly complete property purchases on behalf of clients who cannot attend the notary signing in person. A Power of Attorney granted before a notary in your country (with apostille) allows us to sign the escritura on your behalf.
