Holiday Rental Fine in Valencia: How to Appeal in Spain
Practical guide to appealing holiday rental fines in Valencia: the file, evidence, representations, appeals and the main legal defences.
Legal review: Gabriel Padilla Franco, Elche Bar Association no. 1265 · 9 October 2026
Have you received an inspection record, a proposed penalty or a fine for advertising or operating a holiday rental in Spain? These documents are not all final penalties, and each stage requires a different response. Before paying, deleting a listing or filing generic representations, obtain the complete file, identify the rule relied upon and preserve the evidence.
This guide focuses on how to appeal a holiday rental fine in the Valencian Community. There is no automatic defence: the result depends on the facts, date of the alleged conduct, competent authority and version of the law then in force.
First identify the document you received
- Inspection record or information request: records facts or requests documents; it does not usually impose the fine itself.
- Commencement decision: formally opens proceedings and identifies the alleged facts, possible offence, responsible person and authority.
- Proposed decision: assesses evidence and recommends an outcome while normally allowing a response before the final decision.
- Penalty decision: determines the proceedings and states the available remedies.
- Enforcement notice: concerns collection; challenging the merits and stopping enforcement are separate issues.
The full notice, including the remedies section, is essential. We do not calculate a specific expiry date without checking the document, type of time limit and applicable calendar.
Which rules may apply?
A holiday rental can be subject to several layers at once:
- Regional tourism law: Valencian Act 15/2018 and Decree 10/2021, including amendments in force.
- Municipal planning law: permitted use, licences, occupation documents and local rules.
- Administrative penalty procedure: Acts 39/2015 and 40/2015, including legality, precise classification, responsibility, proportionality and protection against duplicate punishment.
- Guest registration: documentary and reporting duties governed by Royal Decree 933/2021.
- Community of owners: statutes and resolutions may restrict tourist use; this civil issue does not replace administrative controls.
- Platforms and registration: the code on Airbnb or Booking and regional registration do not by themselves establish planning compatibility.
The Supreme Court’s partial annulment of the State register did not legalise unlicensed properties or cancel regional fines. Conduct that commonly triggers proceedings
Authorities may investigate operating without required registration, inaccurate declarations, exceeding capacity, omitting a number, missing habitability or planning documents, breaches of advertising, assistance or guest-registration duties, and obstruction of an inspection.
