Modelo 790 Payment Deadline: What Happens If You Pay Late — Surcharges, Enforcement and How to Regularise (2026)
The Modelo 790 is the form used to pay Spanish State administrative fees (NIE, TIE, citizenship, criminal record certificates, qualifications…). 1. Starting point: the 790 is a fee, not a tax
The Modelo 790 is the standard form used to pay Spanish State administrative fees. The best-known codes are:

Its legal nature — a fee, not a tax — drives everything else. A fee is paid because you request a service or an administrative act, and payment is a procedural requirement. That is why paying late has very different consequences from filing a late income tax return.

2. Is there a "deadline" to pay the 790?
There is no general statutory payment deadline for the fee itself. What exists is the validity of the payment receipt and the procedural deadline of the file it belongs to.
a) Validity of the receipt
The receipt must be filed with the application. Where too much time passes between payment and filing, or where fee amounts are updated, the office may require a new payment or the difference.
b) Procedural deadline
Where the administration formally requests payment inside an open file, the deadline is strict: ten working days from notification, under Article 68 of Law 39/2015. Failure to comply means you are deemed to have withdrawn the application and the file is closed.
That is the real "790 deadline", and it causes most of the avoidable closures we see.
